Acceptance of General Terms and Conditions
1. The contract stipulated between Sidermarine srl and the Customer shall be considered concluded with the acceptance of the order by the Seller. Such acceptance shall be deemed tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure and fully accepts the general conditions and payment conditions transcribed below.
2. If the Customer is a consumer (i.e. a natural person purchasing the goods for purposes not related to his or her professional activity), once the on-line purchase procedure is completed, he or she shall print or save an electronic copy and in any case keep these general sales conditions, in compliance with the provisions of Legislative Decree 206/2005 (Consumer Code) and subsequent amendments.
2.1 Order cancellation (for companies)
In the case of purchase as a company, it is possible to cancel specific requests for goods ordered specifically for the Customer himself, only by paying a 50% cancellation fee.
For orders of goods available 'normally' on https://www.sidermarine.com/gb/ cancellation can be made at any time.
3. Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual responsibility for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order by Sidermarine srl.
Terms of purchase:
4. The Customer may only purchase products in the electronic catalogue of Sidermarine srl at the time of placing the order and viewable online at (URL) https://www.sidermarine.com/gb/ (from now on "Site"), as described in the relevant information sheets. It is understood that the images accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, but may differ in terms of features, colour, dimensions, and accessory products in the picture. All purchase support information (Glossary, Purchase Guide, etc.) is intended as mere generic information material, not referring to the real characteristics of a single product.
5. In the event of non-acceptance of the order Sidermarine srl guarantees prompt notification to the Customer. What has already been stated in point 3 of this deed remains understood.
6. In case of non-execution of the order due to the unavailability, even temporary, of the goods, Sidermarine srl will inform the Customer within 7 (seven) working days, starting from the day after the Customer has sent the order through the site, and within 10 (ten) working days to refund any sums already paid. The reimbursement shall be made by bank transfer or PayPal, only after receiving by email from the Customer his/her bank details or email address associated with PayPal.
Invoicing modalities:
7. For each order placed on the Site, Sidermarine srl issues a regular receipt for the material shipped.
If an invoice is desired, the Customer, when registering on the Site, shall communicate all tax data including pec or SDI for issuing the electronic invoice. The invoice shall be sent in electronic format, as per current legislation. Under no circumstances shall invoices be issued after the tax receipt has been issued, as required by law. The prices of each item are always VAT INCLUDED.
Methods of payment:
8. PayPal
In the event that the Customer chooses to pay the order through PayPal's external circuit (www.paypal.it), the total amount of the order will be immediately charged by PayPal (registration on the PayPal site is required). Payment shall be made within 7 (seven) days from the date of the order. After this deadline, the order shall be automatically cancelled.
8.1 In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by Sidermarine srl, after any payment, at the same time as the cancellation, the amount relating to the cancelled orders will be re-credited to the Customer's PayPal account. The time of re-crediting to the payment instrument chosen within the Paypal account depends exclusively on PayPal and the banking system. Once the amount has been re-credited to the Paypal account, in no case Sidermarine srl can be held responsible for any damages, direct or indirect, caused by delays in the actual re-crediting dependent on Paypal or the banking system.
8.2 Sidermarine srl reserves the right to request additional information from the Customer (for example: document, landline telephone number, etc...) to determine the actual ownership of the PayPal account. In the absence of the requested documentation, Sidermarine srl reserves the right not to accept the refund of the order.
8.3 At no time during the purchase process, Sidermarine srl is able to know the information relating to the Customer's credit card associated with the PayPal wallet. Therefore, in no case Sidermarine srl can be held responsible for any fraudulent or improper use of credit cards by third parties, when paying for products purchased on the Site.
9. Credit cards
If the Customer chooses to pay the order by credit card through the PayPal circuit that manages payments, the total amount of the order will be immediately charged to the credit card provided by the Customer. Payment shall be made within 7 (seven) days from the date of the order. After this deadline, the order shall be automatically cancelled.
9.1 In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by Sidermarine srl, at the same time as the cancellation, the amount relative to the cancelled orders will be re-credited to the Customer's credit card or, if not possible, to the Customer's bank account. Re-crediting times depend exclusively on Paypal and the banking system. Once the amount has been re-credited, under no circumstances may Sidermarine srl be held liable for any damages, direct or indirect, caused by delays in the actual re-crediting dependent on PayPal or the banking system.
9.2 Sidermarine srl reserves the right to ask the Customer for additional information (for example: document, landline telephone number, etc...) to determine the actual ownership of the credit card used. In the absence of the requested documentation, Sidermarine srl reserves the right not to accept the refund of the order.
9.3 At no time during the purchase process, Sidermarine srl is able to know the information relating to the Customer's credit card inserted in the PayPal wallet. The sensitive data of the cards are managed and stored by Paypal.com. So in no case Sidermarine srl can be held responsible for any fraudulent or illegal use of credit cards by third parties, when paying for products purchased on the Site.
12. Advance Bank Transfer
The Advance Bank Transfer form of payment is possible on all catalogue items on the Site. In the case of payment by bank transfer in advance, the order will only be processed after receiving confirmation of the bank transfer. Payment must be made within 7 (seven) days from the date of the order. After this deadline, the order will be automatically cancelled. The reason for the bank transfer must state: the reference number of the order, the date the order was placed, and the name and surname of the order holder.

Delivery methods and costs:
13. No responsibility can be attributed to Sidermarine srl in the event of delays in the execution of the order or in the delivery of what has been ordered.
14. At the time of delivery - which is intended as being at street level, not on the floor - the Customer is required to check that the number of packages (the parcels) being delivered corresponds to that indicated in the consignment note or transport document and that the packaging is intact, undamaged, not wet or in any way altered, including the sealing materials (adhesive tape or metal straps). Any damage or mismatch in the number of packages or indications must be immediately reported to the courier making the delivery by marking the transport document with the words "Withdrawal subject to reservation due to...", indicating exactly the defect found. Once the courier's document has been signed without the wording "Withdrawn subject to cause....", if any, the Customer shall not be able to raise any objection regarding the external characteristics of the goods delivered. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported to Sidermarine srl within 2 (two) days of delivery, according to the procedures set out in this document. Even if the packaging is intact, the goods must be checked within 2 (two) days from receipt.
15. Stock of goods
In the event that the courier is unable to deliver the goods for reasons attributable to the Customer (addressee unknown at the address, addressee absent, goods relinquished, goods diverted, etc.), the Customer shall be charged the opening costs of 10.00 (ten) Euro, VAT included, and the redelivery cost equal to 50% of the transport costs. The costs shall then be charged to the Customer.
16. Right of withdrawal.
Pursuant to articles 64 et seq. of Legislative Decree 206/05, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity, or does not make the purchase by indicating a VAT number in the order form to Sidermarine srl) he/she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 14 days from receipt of the order. 17. To exercise this right, the Customer must send Sidermarine srl a communication to this effect, within 14 (fourteen) working days from the date of receipt of the goods by the courier. This communication must be sent by email or via an automated procedure from your profile on the Sidermarine srl website. Once the aforementioned withdrawal notice has been received, Sidermarine srl Customer Service will promptly communicate to the Customer the instructions on how to return the goods, which must reach Sidermarine srl within 14 (fourteen) days of authorization. 18. In the event that the product received by the customer is damaged from the moment the package is opened, or clearly not compliant with what was purchased, the Customer has the right to withdraw from the order by requesting collection at Sidermarine srl's expense. However, if the Customer exercises the right of withdrawal for other personal reasons (changed mind, product no longer necessary), the return costs will be at his expense.
